Legislative authority for the council expired on 1 June 1998, however the council continued to operate until Governor Jim Hodges established the South Carolina African American Heritage Commission under an executive order (EO 01-39) dated 14 November 2001. A Joint Resolution passed in 2007 (Act 47) renewed its legislative authority and codified its purposes. The members of the commission are appointed by the South Carolina Archives and History Commission and represent all regions of the state. The Commission's efforts to promote African American heritage are conducted through publications, presentations and workshops; support for African American heritage education at all grade levels, establishing a network of African American interested in historic preservation, encouraging the employment of African American professionals by historical agencies and organizations, and offering advice to the Dept. of Archives and History on matters associated with African American heritage. The commission is funded through the Historic Preservation Grant Fund.
