A month ago, I applied for a permit to sell pre-cooked hot dogs from a hot dog cart at Folly Beach on the weekends. This is a very simple operation for which I want to try and make a few extra dollars on the side. I have my Folly Beach City license, my SC Retail license and my cart meets the standards set forth by SC DHEC as far as construction. I plan on using the American Legion on Folly Road as my DHEC approved kitchen. Now DHEC tells me that I have to park my cart at the American Legion. What bothers me is this: There is another hot dog cart that uses the American Legion kitchen as their kitchen but they are not required to park their cart at the Legion. I was told by DHEC that they don't have to because they signed up before it became a regulation. However, I have to park MY cart at the legion. This is unfair. If I must park my cart at the kitchen I use, then all other food service vendors should also park their carts as well. I think I understand the reasoning by having a vendor park his cart at the kitchen is so that the cart owner is more apt to prepare food and use sanitary practices to preserve and protect the health of SC citizens. I maintain that it is DHEC's responsibility to include EVERY mobile food cart vendor to adhere to this new regulation. If they do not, then DHEC is subjecting SC citizens to unregulated food cart vendors who may not use sanitary procedures. As a state agency that oversees human services issues, DHEC is remiss in its duty to make every food cart vendor adhere to this new regulation. I can not understand why DHEC is almost making it impossible for me to start my own very small business. The American Legion doesn't have room for me to park my cart there and they say it doesn't fit in with their insurance coverage. However, this other hot dog vendor remains to be able to park his cart at his house. Do I have any recourse? Shouldn't all other vendors adhere to this new rule if I must?
