On October 13, 2009, my friend Paige Martineau, then 22 and a student at the University of South Carolina, was violently attacked and stabbed by Richard Guest, a 57 year old paranoid schizophrenic living in the apartment below Paige's then boyfriend. Mr. Guest was charged with kidnapping and assault and battery with intent to kill (Richland County cases K613480 and K613488). He was facing up to 50 years in prison before he was deemed incompetent to stand trial and transferred to a mental health facility. Yesterday we discovered he may be released without a trial, pending a hearing tomorrow, Friday, June 10. However, according to SC Code 44-23-460, even if someone is mentally ill and no longer a danger, he is to face trial unless his possible sentence has expired, which it clearly has not. Paige is currently en route to Columbia to try to keep Richard Guest from gaining his freedom. Paige is terrified he could find her or bring harm to someone else if he is released.
