Hutto to chair malpractice study committee

Sen. Brad Hutto, D-Orangeburg, will chair a state Senate subcommittee charged with studying medical malpractice and liability limits.

The subcommittee continues the work of the Patient Claims Subcommittee, which considered medical malpractice matters in 2005. That subcommittee’s work resulted in the “Unanticipated Medical Outcome Reconciliation Act,” a bill sponsored by Hutto and others that encourages alternative dispute resolution in medical malpractice matters. The bill became law in June.

The new Medical Malpractice and Liability Limits Subcommittee will consider other concerns, including reviewing medical non-profits’ and charitable organizations’ liability when treating patients, according to a press release from the Senate Judiciary Committee.

The subcommittee is also expected to look at areas of medical care where a system of “no-fault recovery” could be established for some catastrophically injured patients.

The first subcommittee meeting and public hearing will be held at 10 a.m. Tuesday, Sept. 12, in Room 105 of the Gressette Building on the Statehouse grounds.
