Dealing with them is right up there with dealing with the IRS, one of the most stressful, frustrating experiences of my life. I applied for unemployment benefits back in May of 2015 after losing my job of 4 years because they sold out to another company. I collected unemployment for 2.5 months then got a job with LPL Financial in Charlotte, NC. I worked there for 4 months then the dept I was in was outsourced to a company out of India, HCL. So I reapplied for my benefits in Dec. My wife and I have been out of town a lot over the last 2 months because of a family related issue. However, I continued to search and apply for jobs by logging on to the SCWORKS website and other job searching websites and services. While we were out of town for 2 weeks in mid Dec I opened the SCWORKS website on my computer at home before we left and kept it open so that I could easily remote access my computer at home to do searches and apply for jobs no matter where I was at. When I contacted SCDEW about not getting my benefits check for those 2 weeks I was told it was because I did not login to the SCDEW website at least once a week which is a requirement. I'm on the SCDEW website almost every day. I was told by the SCDEW rep that you get credit for accessing the website when you log out. I explained to her what I did and told her that I did access the website during that time and the reason it's not giving me a credit is because I didn't actually logout of the website during those 2 weeks. She said she took notes and would "pass it on" and I woudl receive a notice in the mail with the updated status. I still never received my benefits. Most recently we were out of town again from Jan 6 - 21. During that time SCDEW sent me a letter for a eligibility review (which I already attended in May 2015) scheduled on Jan 20th. The letter was sent on Jan 9th. We weren't home to get the letter and got back a day after the scheduled appointment on Jan 20th. Again, I explained to 3 reps at SCDEW that I very well couldn't attend, or reschedule the appointment if I didn't know about it. Each of the reps agreed with me and again they all said they would "pass it on" and that I would receive a letter in the mail updating my on my status. I received a notice that was mailed Jan 29 saying that I have been disqualified from receiving benefits because "the reason I gave for failure to report to the eligibility review in a timely manner is not considered good cause under the SC code section 41-35-110". URGH!!!!! I called SCDEW the next day to complain. The rep I spoke to told me that I would have to file an appeal, which I did yesterday. Today I get another notice that says that I have been disqualified again because for the time that I was out of town I was not available for work. URGH!!! We were in Myrtle Beach during both times we were out of town tending to an issue/crisis with our son and his family (our grandchildren). During those times I continued to diligently search for a job, applied for several jobs, accessed the SCWORKS website, and if I got an interview or a start date I would have been back in town within 3.5 hours. Now I just got another notice that I was overpaid benefits and now owe SCDEW $652 for the week I was paid Jan 9 - 16 because I was not available for work during that time. $652 is 2 weeks of benefits, the notice said I was not eligible for only 1 week. I'm not proud to have to file for unemployment benefits. I've been working since I was in 4th grade. I am a US Air Force veteran and had a long career at Microsoft. I don't anticipate being out of work for much longer, and I'm actually exploring starting my own business. But right now we desperately need my unemployment benefits to help pay for the necessities like rent, utilities, phone, etc... As my wife barely makes enough.
