South Carolina Seed License Applications due JANUARY 1
COLUMBIA---Applications for South Carolina Seed licenses may now be obtained on line in a Portable Download File (pdf) format at the state’s website by logging on to http://www.scda.state.sc.us/Forms/SCSEED01.pdf.
Under Section 46-21-40 of the South Carolina Code of Laws (Seed Law), anyone selling or offering or exposing for sale or for distribution must register with the SC Department of Agriculture and pay an annual fee on January first of each year. A receipt, issued by the SC Department of Agriculture and authorized by the Commissioner of Agriculture, is considered a license to conduct the seed business.
The Seed Law states that every parcel, package or lot of agricultural seeds sold and delivered to any person for seeding purposes, weighing 10 pounds or more, whether the seller's place of business is inside or outside of the state, must bear a distinct label or tag in written in English in legible type applied in a conspicuous place on the outside which includes the following information:
Any person who sells or offers or exposes for sale or distribution in this state any agricultural, vegetable or flower seed must comply with the requirements of the Seed Law. A violation of the Seed Law is considered a misdemeanor and punishable by a fine.
