I'm seeking assistance in a matter with DHEC, OCRM that I've attempted to resolve for almost 2 years. The issue is with my dock at 54 Waterway Island Dr., IOP, SC. Over 30 years ago I tied to my dock, a plastic boat float system, to store my boat for protection from the elements. At that time, I was told by SC Coastal Council, no permit is needed for such a system. I installed a second system in 92 or 93, and was informed by an SCCC attorney, Cotton Harness, no permit was needed as long as it was not permanently attached to the dock structure. Over the years, I've made changes to my system to accommodate watercrafts I've owned. I have submitted two requests to OCRM, one in 1998 widening a 2' X 10' section of fixed walkway, and the other in 2013 to replace 4 pilings. These requests were approved. In summer of 2014 a representative from OCRM came by my home, unannounced, stating she wanted to inspect the pilings that were replaced. Instead of discussing the pilings, she began asking questions about the boat floats. Months later, I received a letter telling me to remove my floats. I have since received an order from DHEC to remove them and pay a $3000 fine. I have requested a final review by the DHEC Board, but I have been told they very seldom grant a review. If the board does not grant a review, my only alternative would be through the administrative law court. This action could cost me as much as $25,000. All changes to my fixed dock have been approved by OCRM. I have offered to permit my boat floats, but was told they would not issue a permit. Seeing that I was informed by SCCC no permit was needed for a boat floating system and they have been at my dock for over 30 years. I feel OCRM is not treating me fairly.
