The order will stay in place until all the justices can convene next month to discuss the case, according to the ruling issued by Chief Justice Jean Toal on Friday.
The State Law Enforcement Division is challenging Circuit Court Judge Perry Buckner's ruling that found the Chess Challenge II games are games of skill and not of chance and are therefore legal under South Carolina's video gambling laws.
Court papers say both sides agreed to the order.
SLED is asking the justices not just to overturn the lower court ruling but also to order judges only to rule on the machines brought before them instead of all machines in the same class.
