Rainey, I am also her mother-in-law. Azalee received social security benefits or some sort of disability most of her life. When she was a child she received if off of her fathers benefits, 247-58-5071C6. From 06/2013 until 12/2013 she received benefits under her own social security number. We received a letter from Social Security with a date of 11/23/13 stating that Social Security had paid Azalee 19,577.30 too much in benefits and they would start collecting the overage in 01/2014. I called Debt Management and explained that Azalee is a 28 year old female with an IQ of 38 or lower that was diagnosed with mental retardation before she was 18 and that I was her payee. They were reluctant to speak to me because they were showing that someone else was her payee. They finally found proof showing that I was her current payee and began to talk with me. The overage was created under her fathers social security number and that there were several different payees on her account when she was a child. When Azalee was 15 or 16 her mothers boyfriend was accused of sexually abusing her, she was placed in a group home. She stayed in the group homes until she married my son in 12/2004; they met in Special Education class in high school. I've explained several times, over the phone, by letter and in person that from me talking to different Social Security customer service reps, they (SS) was still sending checks to the payees address who were on file at the time. It was that payee responsibility to contact the Social Security Office and inform them that Azalee was no longer in the home. I've tried to explain to them that it's not fair to make her pay the complete overage back, if she was not living in the home. I ask them to investigate and explain to me when the overage took place, they (SS CSR) told me the files are such a mess they can't make clear of it, but by law it's Azalee's responsibility to pay it back. It seems the government agency is abusing their power and wanting to take the easy way out, collecting the overage money the easiest way possible. It's easier for them to hold her check then it would be for them to investigate and find out who was being fraudulent to the government, and make them responsible. In the mean time my husband and I have to take care of her financially once again. My husband had to take a contract job over in Afghanistan because it was so hard for him to find gainful employment and we had gotten behind on our bills and was close to losing our home. I've had to resigned from my position as a medical biller at the doctor's office I worked at for the past eight years, to be home in order to take care of her and her family. Azalee doesn't read or write, I have to take her to all of her appointments, do the paperwork and actually talk and comprehend for her. Her husband, my son has a cyst on his brain which causes him to have seizures making him unable to drive. The cyst is on the memory part of his brain, he forgets and has a hard time with comprehension. My husband and I have obtain legal guardianship for the three year old because it's in her best interest. I receive no support in any way from Azalee's family or any other agency. My husband is out of the country a year at a time, we get to see him once a year. My life is on hold while I devote most of my time to this family. No one at Social Security cares enough to do the right thing, investigate this matter. It seems that our government is living up to its bad reputation. I would like governor Haley to contact Social Security on Azalee's behalf and insist that they research the history of this 19,577.30 overage and if Azalee wasn't living in the home and her payee was still receiving disability checks on her behalf, knowing that she was no longer in the home; that person should be held accountable, not Azalee. I would also like to be informed of their proof/findings after they research the fraud, if possible. Social Security shouldn't make a mentally retarded/challenged young lady who depends on the 643.00 she was receiving monthly for her lively hood be held responsible, because as they say, they are within the law by making her pay the complete overage.
