I have served around 10 years in the SCNG. I certainly have my fair share of injuries and medals from service and deployments with the SCNG. This summer, after a vehicle accident, I had a healthcare professional (who is also a family member) broadcast my specific injuries and other protected HIPAA information on social media sites. There were multiple postings that constitute a serious invasion of privacy that I believe to be prohibited by HIPAA law. I was a Combat Medic in the SCNG and required all leaders to be HIPAA trained in order to receive health information from me, my office, or my staff. I also trained those leaders on HIPAA law when necessary. In short, I am very familiar with laws concerning health information. By email, I contacted an investigator, Jenna Crum, from SC LLR about the HIPAA violation last week with an attachment showing one of the "Facebook" postings. I asked for acknowledgement of receipt of the email. When no response was received, I emailed the general Nursing Board at NURSEBOARD@llr.sc.gov and asked for acknowledgement that the email was received. I have yet to get any answer from SC LLR. I believe that I may have to eventually mobilize VA resources, and other federal resources, to get the violation investigated. Obviously, SC LLR's lack of concern over this breach will be reported also. However, I still believe in the "Chain of Command" so I will seek some help from the State Executive branch before contacting federal assets. Please respond by email when this message is received.
