Ms. Cooper,

This is in response to the May 4, 2016, letter to Governor Haley from Mr. Burton J. Irvine regarding repair of a failing bulkhead adjacent to his property in the Cherry Grove area of North Myrtle Beach (off of 48^th Avenue North (S-26-1252)) in North Myrtle Beach. Although we understand Mr. Irvine's concerns regarding this situation, it is not within the scope of the SC Department of Health and Environmental Control’s (SCDHEC) authority to construct or repair this type structure. However, this area is considered to be tidelands critical area and the South Carolina Coastal Zone Management Act, S.C. Code Ann. �48-39-130(A) and 23A S.C. Code Ann. Regs. 30-2(B), as amended, requires that any activity in or alteration of any critical area be permitted by SCDHEC.

Mr. Irvine indicated in his letter, and it has been confirmed via review of Horry County GIS, that the property on which the bulkhead is located is owned by the State of SC, similar to other surrounding tidal marsh areas. Per conversation with SCDOT, since this bulkhead is not situated within the right-of-way the adjacent roadway, they have stated they do not have any plans to perform maintenance on this failing bulkhead.

If the Department of Administration, on behalf of the State of SC, wishes to repair this bulkhead SCDHEC staff will be happy to explain the permitting process and work with you to submit an application for review.
