It appears that the South Carolina Department of Revenue has decided that in order to receive the 4% Active Duty Military Special Assessment that there no changes in the tax rate. The law as written doesn't allow Active Duty members to get the tax rate back if they were transferred away and didn't submit the paperwork. I didn't know about the change in the law so I didn't apply the first year it came into affect so I was at the 6% tax rate, but I found out about the law changed and was able to submit my paperwork by the deadline for the second year. Now the third year I'm being told I am not eligible. I know money is tight for everyone, including state and local governments, but appears to me that this law was written to allow member of armed forces to keep the 4% tax rate when they were transferred out of South Carolina, to reduce short sales and foreclosures. Unfortunately like almost all others, I didn't have a choice about transferring out of South Carolina. I was told it was time to go. That being said my house was underwater so I had a choice to make. What do with it, do I short sale it, do I sell it at a loss, do I let it go into foreclosure, or do I rent it and move back or sell it when it isn't a financial drain. I choose to rent it out. Fortunately, I am able to make the mortgage payment when I have a tenant. I don't think this is the case for all the other transferred active duty, and the higher tax rate makes it even more difficult to pay the mortgage. This law was unanimously approved in the House and Senate and signed by the Governor to help active duty military. I extremely disheartened that the South Carolina Department of Revenue has taken this approach toward the country's active duty military that served in South Carolina. My house and many other are still underwater making it difficult to have options.
