On Feb. 13, 2015 my daughter and I were assaulted inside the Northwoods movie theater in North Charleston, SC. Two off duty North Charleston police were working there. The girl who attacked us was talking loudly during the movie.  My daughter got her attention and asked her to please be quite we're trying to watch the movie.  The girl jumped up and said several things.  Then she sat back down.  About an hour and half later when the movie was over and we were leaving.  We saw the girl waiting for us, so we cut across the theater to leave, when we got near the bottom of the steps the girl was there waiting for us.  She started attacking my daughter.  During the attack I was forcefully kicked down.  The girl was viciously beating and kicking my daughter. I screamed for someone to get the police.  If the policeman had not came and got the girl off of my daughter, I believe this girl would have killed my daughter or severely injured her. The girl was arrested and charged with Assault and Battery 3rd Degree.  I have been trying to get it upgraded to 2nd Degree or at the least high and aggravated 3rd Degree.  I have called the Solicitor's office, I've talked to several detectives, the North Charleston Victim's Advocate's office, and the arresting officer to no avail.  They said since she didn't have any broken bones they can't increase the charges.  My daughter has a severe concussion.  She has been out of work for three weeks.  I got a continuance until March 18, 2015, on the court date, due to the doctor writing she shouldn't be making any legal decisions right now due to the severity of the concussion. She has post concussion syndrome. The arresting officer didn't take any statements from me, my daughter, or the other witnesses.  We're being told that since he was there and saw part of the attack, he didn't need to get our statements. The problem with this is he didn't see the girl beating my daughter's head into the concrete floor.  He only seen her hitting her and pulling her hair. So everyone is treating this like it's a simple assault when it wasn't.  I'd appreciate any help you can offer us.
