Dear Mr. Easterling,

Thank you for contacting the Governor=92s Office with your concerns regarding the recent arrest of the Solicitor of the Eleventh Circuit.  At this time, it is our understanding that Mr. Myers has been arrested for driving under the influence but has not yet been indicted, which is a process begun by prosecutors and ultimately decided by a grand jury.  Additionally, it is our understanding that Mr. Myers has issued a public statement that he will not seek reelection this November.

Pursuant to the State Constitution, when a public official is indicted of a crime of moral turpitude, the Governor may suspend the official until he or she is acquitted or convicted.  Recently, however, the Attorney General determined that driving under the influence is not a crime involving moral turpitude, and therefore, the Governor may not suspend Mr. Myers if he is indicted.

Like you, the Governor takes seriously any matter involving unlawful conduct by an elected official.  Governor Haley swore an oath to uphold the Constitution and Laws of South Carolina and will continue to do so for the duration of her service.

If there is anything else our office can do for you, please let us know.

Sincerely,

Rebecca Schimsa
Governor=92s Office
