I am contacting you about 2 modification hearings I have had in Dorchester County.
The 1st hearing was on May 29, 2012. When I went to the hearing I was not given a copy of the Worksheet A with the modification of the child support order. I knew that the caseworker who prepared the worksheet had my gross monthly income incorrect but when I asked was told it was correct and she did this every day. I tried for 42 months to obtain a copy of the worksheet to no avail. Finally, I went to family court 1 more time and asked and was given a copy of the work sheet. I finally found out this was a matter of public record and they could not deny giving this to me. This after numerous trips, phone calls and lost time from work.
When I received the work sheet I recalculated the child support from 2012 and found some discrepancies.
The preparer had taken my YTD as of 5/5/12 $18,874.19 and came up with $4,719. How did the caseworker get this number? This is not documented on the worksheet(what divisor she used).
The preparer took my ex-wife's YTD and divided it by 5.5 and her supposed paystub was as of 5/15/12. I have been to 2 modification hearings and my ex-wife has never shown verification of her income. I have asked about this and no answer is given.
I asked for an audit of my child support file and was told this could not be done.
When this mathematical error was brought up by me I could very well see that impacted the rest of my hearing.
When you inquire about any of their calculations they become irritated and act like you are questioning their ability to do their job.
Also, in this hearing I was told I had to sign the child support modification order. I found out that I could have not signed as I requested. This was very upsetting as I have disagreed with both hearings but was told I had to sign.
In the hearing when I asked about the over payment they said we cannot give it back to you. In the hearing the preparer would not add the cost of Healthcare that I am obligated to pay for my daughter. When my insurance at my job changed - higher premiums and less coverage my wife was able to cover Amber and I on her group health insurance at work. When I asked why they could not give me credit for this they said I didn't provide it. My wife and I combine our incomes, expenses etc. When we decided to change our healthcare coverage to my wife's I called Family Court in Dorchester County to make sure this would be OK. I was told that if I pay for the healthcare which I am ordered to do it doesn't matter whose job it is thru I still cover my daughter and would receive credit. This is a substantial credit that I was denied when I made sure that this was OK before I did it.
The health insurance has been modified due to a corrective order when I requested and sent a letter to the State Attorney. I had to put my daughter back on my insurance due to open enrollment time frames and have also requested this correction be made but have not received a response. This was in December of 2015.
I asked to speak with Paul LeBarron and they told me he was not in. When I asked if the modification could be continued and go before a judge they told me no and proceeded.
I am sure there are many that do not pay their child support or meet their healthcare obligations but I do. This is gross negligence on the part of persons employed to do their job correctly and fairly for all persons involved.
I ask that a full review of my child support records be completed and verification of my ex-wife's income be shown. Also, I would like for someone to tell me why my ex-wife's YTD was divided by 5.5 (5/15/12) and my YTD was divided by 4 (5/5/12) - also the number that my YTD income was divided by is not on the worksheet.
How can a caseworker just decide that they will divide my monthly gross income by 4 months for 5/5/12 and her monthly gross income by 5.5 months for 5/15/12?
I contacted the lawyer, Deborah Kane, that went to the May 29, 2012 modification hearing with me, she kept brushing the matter aside. She always made excuses why I couldn't get the worksheet or I should have it. I went to her office on February 10, 2016 for one final attempt to rectify this situation, she had the pink worksheet in her folder. This is negligence on her part also. Where do you turn when you are deceived by the attorney you hire to represent you and also the system?
I have tried earnestly to handle this matter with SC DSS to no avail.
