I have been legally separated for 18 months with no child support order nor any help from my "husband". He refuses to divorce me and they let him claim making a $700 mortgage pymt is in lieu of. I was a former nurse but due to my two boys suffering from autism had to dedicate myself to being their primary caregiver. I've been stalked,audio of threats to kill himself and make me watch as my children were in room that led me to ask for EPO in Family Court. Then they staple a co-parenting plan and he engages in violence at drop-offs. Fast forward my kids are taken and placed into non-family foster care to protect them from the violence. Signed affidavit by a Lieutenant (friends with my husband's attorney) claims when he interviewed my daughter he had a videotape of me coaching her and Judge based on sworn affidavit removed my kids based on a video that didn't exist and I have documents from attorney for PD that show no evidence existed. My autistic son experienced unimaginable trauma and his twin sister's journal during that time was that of a suicidal young lady. My loved ones have spent over $40,000 and have sole custody but am financially depleted. Forensic report DSS had in possession NEVER was introduced and it was very damning in regards to Paul and showed we were victims for years and years of this man and he told me that I can make this stop if you take me back. GAL has billed me double of what judges order stated and I recently requested documents showing she was billing him. Didn't receive and Monday in court 3-10-2014 she stated to judge he had set up a plan! She threatens to put my daughter in a psych ward rather than help her! I'm threatened with contempt (no order exists saying additional therapy is required) but she FORCES me to take my kids to a Catholic counselor 75 mile round trip and I pay out of pocket or she won't rule in my favor? She has reports of relative of their dad exposing herself, moonshine being made and kids are told it's flammable and don't get too close and addiction to painkillers and drives my children around and I have audio of her while she is caring for my kids. GAL promised kids she wouldn't allow this person around them if we did all of the above. Then at hearing I expected her to report findings to judge and she does NOTHING! She was assigned on 11-28-2012 yet NEVER intervened and wouldn't return phone calls before they were REMOVED with me frantically begging her to help. I get a bill while they are in foster care saying pay my $750 deposit and do fill out paperwork about 3 months later! Too late DSS had custody and you did NOTHING! I have sole custody but my kids are forced to be with this abusive woman and their Dad is equally as bad. She threatens my autistic son if he's bad she will throw him out window while she is driving and FEED him to the dogs! She cusses them and refers to herself as their parent. She is paternal aunt and only by marriage! She has been married to Paul's brother less than 2 years yet I as their Mother am told Tina can't be cut out completely as she lives on the same property where my ex lives with his Mother! My kids are terrified! I kept them last two months as GAL told me an agreement was struck between attorneys and I was given protection for my children that Tina couldn't be near them. She promised my kids same at their school with counselor there. Paul wouldn't have overnites and my custody was unbeatable. What did I need to do to ensure my kids safety? Don't go to court on 12-20 with your RTSC why you withheld visitation because there is no need as we have this ägreement"
Paul had visitation same wknd and he violated agreement immediately. I thinking we are protected immediately withhold visitation and my actions are justified by him placing my children in harm's way and knew repercussions. I was NEVER told verbal agreement wasn't binding and they failed to put it in writing so I had no protection and was sent threatening e-mails and threats of custody might go to Paul because his violation pales in comparison to how a Judge feels about visitation. WHAT? My kids lives were in DANGER repeatedly at the hands of this woman and they are forced to be around her and their Dad cusses them and let's them know he will WIN custody one day! My daughter/son myself were victims and my most recent attorney collected a $10,000 retainer late in Sept and then badgered me to sign his self-serving fee agreement 4 months later or he couldn't represent me. WHAT? He had been to court several times and only after he repeatedly behaved unprofessionally in court and wouldn't allow me to weigh in and told me he didn't need me as he was "winning"and yelled out not in one but two court appearances to "Shut-up" I was humiliated and he refused to answer my e-mails for the most part and failed me in every sense of the word. He got agreement signed and then told me if I fought the RTSC that Paul filed I would risk losing my KIDS again. Pay his attorney fee's for today and make up for visitation he lost due to violating what I was told GAL/my/his attorney had reached an agreement or he will prevail on his RTSC because we failed to put it in writing. As if I was aware of this? I still had to protect my kids because they wouldn't do their job. The GAL admitted in court she has never even contacted Tina Kiser so she couldn't really say if she posed a threat so judge ordered visitation as follows: 8 consecutive wknds 10-8 and Tina was allowed as long as their abusive father was in presence during time. My evidence I had collected for 6+ months wasn't even shared with Judge. They used me and my kids and used fear about losing them again to let me know they didn't defend my actions as you chose to PROTECT them but you have to be ready to face consequences and it won't go in your favor. I have damning emails wknd before court and witness (my parents) the threats that were used to silence me. I knew I had 3 attorneys and worst of all a GAL that is criminally negligent as she has done nothing to protect them. She just bills me and they keep the legal process going. Paul has spent less than $6,000 in 18 months yet a VICTIM of domestic violence is punished and kids taken because I can't ensure their safety? He has been found guilty of violating PO and it took 3 months to go to trial. Judge found him guilty suspended fine to ZERO and looked over at me and told me I poured gasoline on the FIRE that led Mr. Kiser to violate! Same judge that granted me the PO and even learned he was the one that called DSS 6 wks before they act to remove them for fear of imminent danger? Videotape they have isn't admitted into evidence and sworn affidavit from Frasier is later found to be fraudulent. Yet I have not yet one attorney that will bring this up in court nor a forensic psychiatrist clinical findings and her suggestions are ever even used in court. DSS was one that took them! They had hoped it would give them grounds to do what they would do days later but it was the opposite yet it's not part of the evidence on RTSC why they should remove them? Why? I suspect my ex's attorney due to him being former asst solicitor perhaps used connections to do what he couldn't do for his client. My daughter was interviewed by Frasier and he promised an arrest but later said he chose not to do so because my daughter had been through enough! Less than 2 wks later they are removed and yet their own papers say they were contacted 6 wks earlier to remove them immediately! Hmmmm really? Same judge that always rules in the favor of someone that violates and holds me accountable for being there! My kids are not sleeping since court on Monday because the GAL didn't do her job in court on Monday and they are in fear for their safety. I have nowhere to go as the GAL that promised them protection when she had to be faced with they didn't put the agreement I was told about in WRITING well she would rather risk their lives knowing what she knows and I have documents to prove it as well as audio and tells Judge she hasn't reached a conclusion about Tina YET and doesn't disclose the danger she poses. If I'm now pro se because my attorney quit on Monday and the drafted version of the order my ex's attorney drafted is nothing that went on in court almost. I noted she swapped case numbers where I have sole custody from 11-28-2012 order we still go by although it's labeled temporary. She switched the RTSC she filed against me for contempt and her entire RTSC was shocking! No evidence presented just allegations as always. She took that case number and transposed it to read temporary order and to do away with the other case number as they are basically same thing! OMG! I spent two hours on my objections to order she submitted to Judge Morris to sign as she puts things in order that weren't even VISITED let alone ordered in her drafted copy. I am desperate. If I submitted to Judge and raised my issues that order she drafted was her attempt of making my TRUE case number obsolete and changing names around on her form. A judge surely wouldn't sign something that was so deeply disturbing and quite frankly criminal intent as that's isn't something you can ignore. Transcripts would prove that but I don't have time. Can I avoid visitation if I don't have a signed copy of order as order was only submitted for approval by his attorney and I immediately showed revisions that had to be made and also started comparing the motion RTSC with what was done in court and it's FRAUD quite frankly. My daughter/son cry all the time and ask why don't they MATTER? My little girl when under severe stress passes out and stays pale. She has to be in the protective mode when they are forced to be around their Dad and this woman for fear they will hurt Bryce as they bully him. Am I risking losing my sole custody because the GAL cares more about not explaining to Judge why agreement wasn't done properly and risk looking inept in court than PROTECTING kids you promised back in December would NEVER be exposed to her again! She promises! Yet now after court e-mails me wanting me to bring my little firecracker, Chloe to her friend the counselor and never before has she wanted to MEET my kids there. Why at therapist office? I'll tell you why. Chloe is mad as hell and wanted answers as to why she lied to them and why didn't you tell Judge anything that was reported? She  told me back in January that it was sad to see kids like my daughter get admitted to a psych ward. OMG! All because I shared Chloe's private journal entries to wake Mrs. Hightower up! I thought she would help her not threaten if she didn't stop writing she might end up there. Now after she FAILED to do her job she wants to meet at therapist office. Why so they can say Chloe threatened to kill herself and they had no choice but to admit the little girl that had serious "issues". I feel she will do anything to help my ex because I dared challenge her judgement calls. She shouldn't even practice law let alone be a GAL! I would send her e-mails begging for help especially these last 4 months and she never responds yet if she has demands of me she expects compliance. She doesn't even mention therapy in court but then they take it on to drafted order as if it exists. Why didn't she? Because she won't bill Paul for anything! It's bizarre. I was shocked to see she had charged almost double of what the CAP on order was for me individually. I have suspicions that she was simply invoicing me on Paul's behalf. Remember same guy that doesn't get ordered to pay child support and I pay for everything and don't have a job! My attorney I suspect quit because he knew I was starting to see he hadn't done his job and violations kept wracking up and I kept being threatened if you don't pay him this (night before court) I get an offer that he won't go forward with his RTSC if I agree to settlement offer judge told him back in October to submit in 45 days and I had 15 to respond. I am e-mailed it night before court and in short pay him close to $40,000 and more ridiculous demands or I might lose my attorney urged me. He thought it was in my best interests? I don't have $4,000 let alone that money to pay him in 30 days or I can continue the 18 months of HELL that we've faced because had I signed it then he would ALLOW divorce. Otherwise mediation. My bifurcation was dismissed on grounds my attorney I found out on 3/10 failed to execute service properly and the battle continues. I was abused by this man for 13+ years and the abuse never stops. He uses the courts to manipulate/harass our family. We are desperate! If I have not been given a signed copy of order just a drafted version that constituted FRAUD is it violating if I haven't heard back if I don't take kids to their Dad this wknd?  My attorney knows I shouldn't have even been in courtroom on 3-10 because I wasn't served properly. I had some lunatic come to my residence where I have signs clearly posted, NO TRESPASSING and wears sunglasses and bangs and my kids think someone is trying to get us and he leaves and returns hours later again. Then following day comes right back to my HOME banging on door for 15-20 minutes. Later that evening a man approaches me in LOWES and smiles and I have no idea who he is as he isn't wearing sunglasses or his "disguise" and calls me by my first name and says I have SOMETHING for you. I have a strong suspicion at that point he is attempting to serve me papers although our attorneys have never used that method before but now I understand my attorney pretended not to know she had filed papers as they didn't want me to be upset they hadn't yet told me the agreement they made didn't get formalized. Long story short I won't accept papers and the man in front of staff at lowes tells me I don't have to ACCEPT them consider yourself SERVED and threw them on the floor while customers and staff watched. The Lowes manager followed the man as he saw I was clearly upset and caught off guard that this man had FOLLOWED me 10 miles hours later to LOWES. Manager told him didn't he drop something and man laughed and said "nope" The manager asked Stephen (my significant other) if he wanted them so he looked over them and put them away. My issue was I informed my attorney that this occurred and he pretended to know nothing of my ex's RTSC against me and even demanded I leave my copy with him. Why? So I wouldn't catch the fraudulent part and realize it had me listed as PLAINTIFF and Paul listed as Defendant and she even refers to Paul as "she"and asks that I pay defendants attorney's fees aka Paul yet he is one that filed and is labeled incorrectly PLAINTIFF. Why play on words she when drafting order to submit to judge I noted she said there were two cases that were basically same and my 11-28-12 TEMPORARY ORDER that judge stated we were to continue to abide by with few tweaks she put the RTSC Case number and turned around and submitted it in order for judge to sign possibly today and instead of my TEMPORARY ORDER CASE number being listed she is putting her same RTSC  Case number and changes it to make it appear to be temporary order as she took the RTSC off of it and I have all of the documents. She is attempting to commit fraud and normally gets by with it but I'm forced to be Pro se and noted the switch immediately and understood why she listed me as plaintiff when she filed it and was going to use the bait and switch and pray it wasn't caught so she could find me in violation of an order that wasn't an order at all but a RTSC filed on her clients behalf! Judge clearly stated it was Judge Smalls and date of my order and my former attorney's name to avoid confusion. This woman filed back in early Jan and anyone that can READ would've caught what she was doing yet nobody reads they just sign order. Switching case numbers around shouldn't be something you can explain away along with the other unethical  behavior. All of the attorneys knew agreement would need to be in effect when they called me night before court in December to give us protection. They said Paul violated it before they had change to draft it so why does he violate as always and I suffer and am ordered to pay his attorney? It's disturbing and we are emotionally exhausted and can't fight a system that won't uphold justice allow his attorney to request a certain judge while my kids listen in horror because Daddy takes them to his attorney's office so they will be terrified as they know this Judge took them away and even when Daddy went to court months later didn't do anything to punish him and let him stalk me and no arrests ever made. Each time we lose in court if he presides but any OTHER time I prevail but I know it won't last long. They plot on how to get me back in court so they can undo my most recent victory. I'm begging for HELP!!!!
