Font St. Mullins, South Carolina 29574 February 25, 2016 The Honorable Nikki R. Haley, I wish to file this complaint against Tax Collector Ms. Carolyn J. Lambert and assistances, in Marion County office located at P.O Box 389 Marion, S.C. 29571. Phone number: 843-423-8230; (New location) Marion County Administrator Building, East Highway 76 Marion SC. 29571. Phone: 843-431- 5059. As, being the successful bidder of this property sold to me at the tax sale (see copy attached). According to "Law on Tax Sales of Real Estate" and delinquent tax sale purchase. It appears that Marion County Tax Collector Ms. Carolyn J. Lambert, and assistances have not complied with the laws which states "if the defaulting taxpayer fails to redeem the say property during the twelve-month period, his title is defeated and the title to the property is transferred to the successful bidder. Von Elbrecht v. Jacobs, supra; §12-51-130. It also stated that "the purchaser will be notified in writing of all applicable fees to be paid prior to the deed to be recorded to the Delinquent Tax Collector's Office. To this day which is 02- 25- 2016, I have not yet received my deed to this property, nor have I received a letter from the tax collector office notifying that the property belonged to me. Marion County tax collector, and assistances as well as their attorney is giving me the run around. They are telling me that "the attorney is doing a title search so that I can get a clear deed". The deed to this property was clear when the redemption period expired, that gave me a clear deed. Marion County Tax Collectors still have my money for the bid, from 11-03-2014 until today which is 02- 25- 2016 for the County tax sale, and now they are holding my deed to this property. They are failing to deliver the tax title to the highest Bidder, which was me. On 11- 03- 2014, I went to the Marion County tax sale and bid on this property located at 1000 Pecan St. Marion SC 29571; property MAP# 516-04-48-000. I have paid the cash amount of $900.00 for this property (See document attached). It has been over a year and I have not yet received my title for this property. I have called several times and spoke with Ms. Carolyn J. Lambert, and her assistant Ms. Porsche at the tax office; I also called and spoke to their attorney "Chunk" Charles McLain & Associates, LLC Attorneys at Law 2141-D Hoffmeyer Road Florence, SC 29501; 843-661-7373 of whom I was told that I needed to call him. On 11-03- 2015, the property became final and I am still waiting for my Deeds. On 12- 03- 2015, I was told by Ms. Porsche at the tax office that it would be some months before I get my Deeds to the property, and then again; on other occasions she stated that she did not know when I would get the Deeds to the property. On Monday, January 01, 2016. I called the tax collector's office to see when I could come by to pick up the Deeds to the property, and I got the same results. I was told by both Ms. Lambert and her assistant Ms. Porsche that they were "setting ducks" just as I was, and that they did not heard anything from their attorney McLain, and again they insisted that I needed to call him. On January 03, 2016 I called Mr. McLain office and left several messages along with my phone number with his secretary in reference to property deed. When I final got a chance to speak with attorney McLain. He stated that Marion County tax office did sent him around ninety-six cases and that he had already completed them. But, there was nothing in the files concerning me or the property which I purchased. He also stated that he called the tax office and spoked with Ms. Porsche requesting that she fax him the copy of the information in regards to the property that I purchased through the sale. Then again, He stated that he was going to go over and pick them up, and as soon as he finished them he would give me a call. I still have not heard anything from him or the tax office, nor have I gotten a letter in reference to my purchasing of the property. I also went to the Marion County Administrator Office located at 1305 North Main St. Marion S.C 29571, and the new location at 2523 East Highway 76, Phone: 843-431- 5059 to file a complaint and to speak with Mr. Tim Harper, but, instead I spoke with a woman whom I took to be Ms. Sabrina Davis which she took the information and went in back to speak with him. Ms. Davis then came back to the front desk and stated that Mr. Harper had told her to call the tax office, which she did and spoked with Ms. Porsche. In reference to the phone call and what was told to me by Ms. Davis. Ms. Porsche claimed that the attorney was still doing research on the property so that I can get a clear deed, and as soon as the attorney finish doing his research I will get my deeds to the property. As I stated before, I have paid my money for this property at the Marion County Delinquent tax sale that was held on November 03, 2014 and here it is February 25, 2016; it has been a year, and three months and about to be four months. I do not have a letter nor the deeds to this property. I have attached my receipt from the Tax sale with the information on it (See document).
