State Rep. Ralph
Davenport, who dreamed up a bill that would outlaw
the sale of sex toys, clearly needs something to
keep him busy.
The Spartanburg County Republican has
introduced a bill that would make it a felony to
sell devices used primarily for sexual stimulation
and allow law enforcement to seize toys from
raided businesses. So far, no other lawmakers have
agreed to sign on as co-sponsors.
Davenport's bill supposedly is aimed primarily
at shutting down X-rated adult bookstores. But
using such a wide net seems likely to invite legal
challenges.
Owners of so-called "couples-oriented" stores
question why they should be targeted. Such stores
sell everything from sexy lingerie to risqué
novelty gifts to various lotions. We wonder how
law enforcement agencies will distinguish between
such stores and the Victoria's Secret shops in
malls across the state.
South Carolina already prohibits the
dissemination and advertisement of obscene
materials. If Davenport wants to go after X-rated
bookstores, that law should suffice -- if he can
demonstrate that the materials actually meet the
legal definition of being obscene.
See how complicated it can get? Lawmakers
almost always run into trouble when they decide to
invade people's private bedrooms.
If couples think they can achieve a more
rewarding sex life with the help of such items,
what business does Rep. Davenport have spoiling
their fun?
While we are at it, doesn't he have something
more important to do?
