Adger and IIDP Administrator: I am writing this email with deep concern about the letter I just received in regards to a recent IID assessment by the Life Safer Company that was forwarded to the Department of Probation, Parole and Pardon Services. I am a night-shift supervisor at Ellett Brothers and I was leaving my shift at 6:10am on November 24th in Chapin, SC. The temperature that morning was 32 degrees. I got into my truck and started it right up. While it was idling and warming up, I smoked a cigarette. Then, immediately I was prompted to blow again. It NEVER entered my mind that a cigarette could cause me to blow a false alcohol reading. I began to panic because I knew I had not had any alcohol and thought maybe the cold weather was affecting the IID device. When I tried to blow at 6:14, 6:15, 6:16, and 6:17am, I was in shock and panic as to what was going on not to mention extremely tired from a 12 hours shift at work. I called my wife because I knew she would be up getting ready for school. She tried to calm me down and told me to drive straight to the IID Service Provider on Broad River Road. I immediately headed to see Ernie at the Auto Shop. He reset my device and charged me $48. He also watched me blow into the device without any violations. He documented everything on told him on his paperwork and gave me a copy. When I got home, I called Life Safer and talked to a woman who assured me that they would review all of the video and do a thorough assessment and call me back. She never called. I called again the next day, 11-25-15. Once again told they would review and get back to me. I called again on 11-30-15 and left a message...no response. Called again on 12-1-15 and told that I would receive a letter. Now to yesterday, December 4th, I received a letter from the Department of Probation, Parole, and Pardon Service. The letter states that I now have a 3.5 point accumulation and will be required to have the device for an extended 4 more months and I am REQUIRED to go to DAODAS for substance abuse! I am totally innocent and have not done anything wrong except smoke and tried to blow and then I repeated the test in order to immediately get to the IID Service Shop for help. I can prove that nicotine can cause this device to give a false reading because I bought a BAC tester, smoked a cigarette and immediately blew into the BAC tester...and BLEW .3- Waited about 5 minutes, retested and blew .0! I also discovered that if I eat a cheeseburger and drink a sprite and blow...my BAC will register as .2. My future is about to be majorly affected if this is not reversed by my appeal. I have not been drinking and this device is not a true accurate device for determining whether a person has just drank alcohol of some sort. It picks up food, nicotine, and I have even heard windshield wiper fluid as alcohol and can cause a false reading. I am currently in contact with a lawyer about this concern and inaccurate device because I feel as though my civil rights are being violated. I have to worry about eating, smoking, chewing gum and all sorts of other things because this device is not an accurate measuring assessment for the reason it was put out there. I do not drink and attempt to drive because I have learned my lesson. I do believe that the IID device has kept folks who have been drinking off of the road and saved lives but I KNOW it is causing some people false penalties and consequences due to malfunctions and inaccurate readings. I need your help in understanding that what I am telling you is the absolute truth and I have many witnesses who can testify that I had not been drinking on November 24 and I was at work from 7:15 pm(drove to work) until 6:10am and simply started the truck, smoked failed, panic and retested several times in sheer shock and disbelief. I am pleading with you to reverse this charge and make sure I am not penalized for false readings due to cigarette smoke.
