Two off duty North Charleston Police Officers were working there. My daughter asked this girl to please be quite we're trying to watch the movie. The girl jumped up and started saying things. Then she sat back down. About an hour and a half later the movie ended. As we were leaving we saw the girl waiting for us, so we cut across the theater and went down that way. The girl was waiting for us at the end of the stairs. She starting attacking my daughter. I was forcefully kicked down. I saw the girl viciously kicking and beating my daughter. I screamed for someone to go get the police. I strongly feel that if the policeman had not come and got this girl off of my daughter, this girl would have killed my daughter or severely injured her. The girl was arrested and charged with Assault and Battery 3rd Degree. I have been trying to get the charges upgraded to 2nd Degree or at the least high and aggravated 3rd Degree. We're being told that since she had no broken bones they can't. My daughter has a severe concussion. She has been out of work for three weeks. She has post concussion syndrome. I got a continuance until March 18, 2015 on the court date due to her doctor writing that she shouldn't be making legal decisions right now. I've called the Solicitor's office, talked to detectives, the arresting officer, and the North Charleston Victim's Advocate's Office to not avail. The arresting officer did not get statements from me, my daughter, or the other witnesses. We're being told that since he saw part of the attack and arrested the girl that he didn't need our statements. The problem with this is he didn't see the girl beating my daughter's head in the concrete floor. He only seen her hitting my daughter and pulling her hair. So everyone is treating this like a simple assault when it wasn't. We'd appreciate any help you can offer. Sent March 8, 2015 at 3:52 pm
