I am submitting yet again to make this issue clear. South Carolina needs to change laws regarding several issues, my first to make known is divorce. I have been trying since December 2014 to divorce my estranged spouse. I had caught him in the act of sexually assaulting one of my children. My family went through all the investigations and was elated when he pleaded out 18 years 9 months with the military judge handing out a 38 year sentence. I was happy to move on with our lives in my home state of South Carolina. However, since filing for an uncontested divorce, I have gotten nowhere. I have served him every copy of every form and summons. Uncontested divorces do not need a response unless it's being contested by the other party; except when it comes to a prisoner. Even after being served multiple times by the sheriff's office, South Carolina requires him to actually acknowledge that he understands the divorce. He has hung up on his guardian. He is in Fort Leavenworth military prison and has access to legal, but chooses not to do so. The state is worried about his rights being upheld. My rights to a divorce, however, are being denied. I have followed all protocol, carry the Military Protection Order (restraining order for myself and all 4 kids), and his summary of trial but still have no say in the courtroom. Instead of me being the plaintiff, I am now feeling as if I'm the defendant. I am constantly trying to explain myself when it should be an open and shut case. My request is that you take this into consideration for changing the law. Many states have if one spouse has at least 1 to 2 years sentencing it's grounds for divorce, why shouldn't South Carolina. It is not fair to make a person stay married to the spouse that sexually assaulted a child and give the guilty more rights. I would appreciate a follow-up concerning this matter.
