I was just made aware of your states very strict sex offender registry laws in October when they came to affect my family. I apologize that it has taken me this long to contact you, but I am in the Army stationed at Ft. Bragg, and I was deployed when this event happened. My stepson was placed on the NC Juvenile Sex Offender Private Registry in January 2015 for molesting his siblings. My wife and I were the ones that discovered what was happening between him and his siblings and reported it to the County Sherriff. We pressed charges because we were told that in doing so would be the only way for him to get admittance to a Psychiatric Residential Treatment Facility that could deal with his issues. After much research we found that one of the best and highly regarded treatment facilities for Juvenile Sex Offenders was Located in Rockhill, SC. The Facility is named New Hope and my son flourished there. He then returned to NC to finish out his probation in a group home. While in his group home he started to attend a public high school, which was great for his reintegration after over a year of being in detention and a treatment facility. That new start for him was short lived when one of his classmates searched my son's name on the internet and found him on the SC Sex Offender Registry then gathered a group of teens to assault him in the schools locker room one afternoon. On January 15th 2016 he had fulfilled the terms of his probation and it was terminated as well as NC removing him from it's Private Sex Offender Registry. My son is now home schooled and lives with his Grandmother in Georgia. He lives in fear everyday because of a mistake he made 2 years ago when he was 12 and the fact that his picture is on the internet for all to see is ruining his dreams and future. The larger fear we have is that his 2 victims, his siblings, my children, who are now in school will see him on the internet and have to relive the pain and deal with this situation for the rest of their lives publicly. The NC Department of Juvenile Justice failed us because they did not tell us about your laws and ensured us that he would not be registered on a public registry. New Hope failed us because they did not tell us that they had taken him to register. I have looked over your state Statues regarding the registry and have found a section that discusses who needs to register and after reading, it seems as if he should not have to registered. Title 23 Chapter 3 Article 7 Section 23-3-460 (G) A person required to register pursuant to this article who moves to South Carolina from another state establishes residence, acquires real property, is employed in, or attends, is enrolled, volunteers, interns, is employed by, or carries on a vocation at a public or private school, including, but not limited to, a kindergarten, elementary school, middle school or junior high, high school, secondary school, adult education school, college or university, and a vocational, technical, or occupational school in South Carolina, and is not under the jurisdiction of the Department of Corrections, the Department of Probation, Parole and Pardon Services, the Department of Juvenile Justice, or the Juvenile Parole Board at the time of moving to South Carolina must register within three business days of establishing residence, acquiring real property, gaining employment, attending or enrolling, volunteering or interning, being employed by, or carrying on a vocation at a public or private school in this State. It clearly states that if he moves to SC while under the jurisdiction of the Department of Juvenile Justice that he does not have to register. I have contacted the SC Sex Offender Registry Unit about this section and they have said that I have misinterpreted the law, and that it clearly means that he had to of been under the jurisdiction of the SC Department of Juvenile Justice. I am having trouble seeing how he could move to the state of SC while already being under the jurisdiction of the SC Department of juvenile justice. I have spoken with their supervisor and she has informed me that if I want to take further action, that I will need to get an attorney and fight the state. We have been constantly let down by every department and person who has said that they could help us, and I am hoping you can help us or at least lead us in the right direction.
