Gov. Mark Sanford's office
isn't likely to make a decision regarding the removal of a county councilman
charged with selling prescription drugs unless and until he is indicted, his
spokesman said Monday.
Spokesman Will Folks said state law prohibits the
governor from acting until a grand jury hands down an indictment.
"At that
point, the governor has the discretion whether or not to issue a suspension,"
Folks said.
Three-year veteran Cherokee County Councilman Billy Olin Wallace,
60, of 219 Bonner Lake Road was charged with possession with intent to
distribute Oxycotin on Friday. He is free on a $30,000 bond.
Wallace won't
comment on the charges and Interim County Administrator Ben Clary said Wallace
hasn't resigned from office.
The S.C. Attorney General's Office will
prosecute the case. The Cherokee County Grand Jury meets May 29.
